Dan Hudson comments in Law360 on FCPA enforcement

Commenting in Law360, Seladore Legal Partner Dan Hudson addressed the implications of President Trump’s decision to halt enforcement of the Foreign Corrupt Practices Act. While this move creates an enforcement gap, the extent to which agencies such as the Serious Fraud Office – or their counterparts in Europe – might step in remains uncertain.

“The SFO may feel pressure to scrutinise U.S. businesses where its jurisdiction allows, but this could carry political risks, particularly so early in Trump’s administration,” Dan noted. He also highlighted concerns over international cooperation, given that many of the SFO’s most significant cases have relied on intelligence from U.S. authorities. Any shift in information-sharing could have serious consequences for cross-border enforcement efforts.
