Dan Hudson featured in Law360

Dan Hudson of Seladore Legal and Christopher Coltart KC of 2 Hare Court have analysed the Economic Crime and Corporate Transparency Act for Law360.

They paid particular attention to the Act’s extension of corporate criminal liability for senior manager conduct (including for non-UK companies) and to the forthcoming introduction of the failure to prevent fraud offence. Dan and Chris speculate that one possible consequence of the Act is that companies will be more likely to be investigating themselves and each other in relation to fraud and other financial offences (and other offences if proposed further extensions are enacted) – this could significantly increase the likelihood of civil claims as well as corresponding investigations by UK law enforcement/regulators.
