Writing in The Times, Seladore Legal’s Simon Bushell analyses how the English High Court has responded to Russian anti-suit injunctions, granted by Russian judges in their belief that sanctioned parties would not get fair or impartial treatment from courts in “unfriendly” countries such as England.

The English court has reaffirmed its jurisdiction through anti-anti-suit injunctions, with one such example being in the case involving Ziyavudin Magomedov (for whom Seladore is acting). This sends a clear message that disputes can and will be litigated and arbitrated in England.

Far from being ‘tit for tat’, the English court is acutely aware of the need to strike a delicate balance between protecting its own legal processes, achieving access to justice, and respecting the actions of foreign courts in the interests of comity.
