In a new article for the Spring 2025 edition of the International Bar Association Litigation Committee newsletter, Seladore senior partner Simon Bushell, partner Kevin Kilgour, and associate Maitreyee Dixit-Mannava examine how English courts are reinforcing their power to grant anti-suit and anti-anti-suit injunctions in cross-border disputes.

The article considers how developments post-Brexit – and legislative changes in Russia – have led to a rise in foreign proceedings that risk undermining jurisdiction clauses and access to justice in England. In response, the English courts have shown a growing willingness to intervene, including in cases without an exclusive jurisdiction clause.

Drawing on recent authorities such as UniCredit Bank GmbH v RusChemAlliance LLC and Magomedov v PJSC Transneft, the authors explore the courts’ evolving approach and the implications for parties seeking to protect their chosen forum.
